Terms and Conditions of the UNITRAILER.CO.UK Online Shop as of 14.06.2017

 

I.  Definitions

For the purpose of these Terms and Conditions, the following terms shall have the following meanings:

1. Customer – natural person, legal person or organisational unit not having legal personality, to whom legal capacity is granted, and who makes an Order over the Online Shop.

2. Consumer – Pursuant to article 22[1] of the Polish Civil Code shall mean any natural person who performs acts in law which are not directly connected to his economic or professional activity.

3.  Civil Code - Act dated 23 April 1964 (Polish Journal of Laws of No. 16, item 93 with later amendments;

4.  Terms and Conditions – the present Terms and Conditions specifying the rules of providing online services within the unitrailer.co.uk online shop.

5.  Online Shop (Shop) – online service available at unitrailer.co.uk, through which the Customer is able to place Orders.

6.  Goods – goods offered over the Online Shop.

7. Sales Contract - any contract for the sale of Goods within the meaning of the Polish Civil Code, concluded between UNITRAILER SP. z o.o. and the Customer with the use of the Online Shop.

8.  Consumer Rights Act – the Act dated 30 May 2014 on the rights of consumers (Polish Journal of Laws of 2014, item 827).

9.  Electronic Services Act – the Act dated 18 July 2002 on the provision of electronic services (Polish Journal of Laws no. 144, item 1204 with later amendments).

10.  Order – Customer's declaration of will that leads directly to signing of a Sales Contract, describing in particular the type and number of Goods.

 

II.  General provisions

2.1. The present Terms and Conditions specify the principles for using the Online Shop available at unitrailer.co.uk.

2.2.  The present Terms and Conditions are considered regulations in the meaning of Article 8 of the Polish Act on Providing Services by Electronic Means.

2.3. The online shop available at: unitrailer.co.uk is run by  UNITRAILER sp. z o.o. ul. Kuźnicza 6-8, 21-040 Świdnik Poland, under National Court Register (KRS) number 0000624998 and personal identification number (NIP) 5213739921.

2.4.  The present Terms and Conditions lay down in particular [depending on availability]:

a)  rules for creating and using the account in the Online Shop.  

b)  rules and conditions for making reservations for products available in the Online Shop.

c)  rules and conditions for making Orders in the Online Shop.

d) rules for concluding Sales Contracts with the use of services provided in the Online Shop.

2.5. The use of the Online Shop is possible only if the computer system used by the user fulfils the minimum technical requirements: IE 7 or later, FireFox 3 or later, Opera 9 or later, Chrome 10 or later, Safari with the latest JAVA and FLASH versions, screens with resolution exceeding 1024 px.   

2.6. In order to use the Online Shop, the Customer should on his or her own obtain the access to a computer station or a device with the Internet access.

2.7.  Pursuant to the law in force, UNITRAILER Sp. z o.o. reserves the right to limit the rendering of services by the means of the Online Shop to the persons at the age of 18 years and older. If such a situation occurs, the Customer will be notified of it.

2.8 Customers have access to these Terms and Conditions at any time, using the reference link at the main page of unitrailer.co.uk webpage, as well as hold the right to download and print it.

III. Terms of use for the Online Shop 

3.1. In order to start using the services of the Online Shop, the Customer is required to register in the shop.

3.2 In order to registrate, the user must fill and accept the registration form available on one of the pages of the Online Shop.
3.3. To register successfully, the Customer must accept the Terms and Conditions as well give all information marked as necessary.
3.4. In case of the violation of the present Terms and Conditions, UNITRAILER sp. z o.o. may withdraw the Customer's right to use the Online Shop as well as limit his or her access to parts or all the resources of the Online Shop with immediate effect, particularly when the Customer:

a) submitted personal details which are untrue, not precise or outdated, misleading or violating the rights of any third party,
b) infringed personal interests of a third party by the means of the Online Shop, especially personal property of other Customers of the Online Shop,
c) performed other actions that UNITRAILER Sp. z o.o. sees as non-compliant with the law in force and general terms of use on the Internet, or undermining the reputation of UNITRAILER sp. z o.o

3.5. A person who has lost the right to use the Online Shop, cannot register again without obtaining a prior consent of UNITRAILER sp. z o.o.

3.6. To guarantee the safety of communication and data with respect to the services provided within the webpage, the Online Shop undertakes technical and organizational measures that comply with the threats to the safety of the services provided, especially the measures that prevent unauthorized acquisition and modifications of the personal details submitted on the Internet.

3.7. The Customer is, in particular, obliged:
a) to refrain from submitting and communicating content that is forbidden by the law force, for instance content that promotes violence or decry and violate personal rights and other rights of a and third party,
b) to use the Online Shop in a way that it does not interfere with its functioning, in particular by using certain software or devices,
c) not to undertake actions such as: sending or submitting to the Online Shop trade information that has not been ordered (spam),
d) use the On-line store in a way that is not burdensome for other Customers and for UNITRAILER sp. z o.o.,
e) use the content submitted by the Online Shop for personal purposes only,
f) use the Online Shop according to the law in force of the Republic of Poland, provisions of these Terms and Conditions and general rules for using the Internet.  

IV.  Procedure for concluding Sales Contracts

4.1. Information on Goods given on the Online Shop web pages, Goods descriptions, specification and prices constitute invitation to form a contract within the meaning Article 71of the Polish Civil Code.

4.2 To conclude the Agreement Contract through the Online Shop, the Customer must visit unitrailer.co.uk website and select Goods following displayed messages and information available at the site.
4.3 To select Goods, the Customer need to add them to the basket.

4.4 While proceeding with the order - until the Customer presses the „Place your Order” button – he or she has the right to modify selected Goods and other data. For this purpose, the Costumer should follow the displayed messages and information available on the site.

4.5 After submitting all the necessary information by the Customer using the Online Shop, an Order summary will be displayed for the Customer. An Order summary includes the following information:
a) the ordered products,
b) unit price and total price for the ordered products or services, including shipping costs and additional costs (if applicable),
c) the chosen payment method,
d) the chosen shipping method,
c) the time of delivery.

4.6. For the Order to be shipped, the Customer must accept the Terms and Conditions, submit his personal details marked as obligatory and press "Place your Order".
4.7. Placing an Order by the Customer is a declaration of a will to sign a Sales Contract with UNITRAILER Sp. z o.o, in accordance with the content of the Terms and Conditions.
4.8. After placing the Order, the Customer receives an e-mail containing the final confirmation of all important Order details.
4.9. The Sales Contract is considered concluded at the moment of the reception of the above mentioned e-mail by the Customer.
4.10. The Sales Contract is concluded in English and its content is consistent with the Terms and Conditions.

V.  Delivery

5.1. The  Goods are delivered to the address within the UK given by the Customer while placing the Order.

5.2. Delivery period is 1-10 working days from the day of placing the Order by the Customer for the Republic of Poland, and up to 21 working days for deliveries abroad.

5.3. The Products are delivered with a courier parcel: DPD, K-EX, Poczta Polska, Paczkomaty In-Post, Raben. The costs of delivery may be verified at www.unitrailer.co.uk/delivery.  The cost of delivery will be specified while placing an order.

5.4. The order completion date is 1-14 business days  from the day of the purchase.

 

VI.  Prices and payment methods

6.1. The prices of Goods are given in  GBP and contain all the components, including 23% VAT and customs duty.

6.2. The Customer may use the following payment methods

a) money transfer to the bank account 24 1020 3176 0000 5302 0241 3573,

b) PayPal.

VII.  The right to withdraw from the agreement

7.1 The Customer who is at the same time the Consumer has the right to withdraw from the remote agreement within 30 days. The Consumer has the right to withdraw from the present agreement within 30 days without stating a cause. After 30 days from the day of receiving Goods by the Customer or a carrier the right to withdraw from the agreement ceases.

7.2 To use the right to withdraw from the agreements, the Customer must inform UNITRAILER sp. z o.o. ul. Kuźnicza 6-8, 21-040 Świdnik Poland, mail: unitrailer@unitrailer.co.uk on his decision to withdraw from the agreement by an unequivocal statement (e.g. a letter sent by post or e-mail).

7.3 To retain the right to withdraw from the agreement, the Customer must send the information concerning exercise of the right of withdrawal before the withdrawal period has expired.

7.4 Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), shall immediately, and in any event not later than 14 days after the termination of the contract, inform us on the decision of the exercise of the right of the withdrawal. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless the Customer agreed otherwise; in any event, the Customer will not incur any charges connected to the reimbursement.

7.5. We may withhold reimbursement until we have received the Goods back or the Customer has supplied evidence, depending on which of these conditions is met first

7.6. The purchased products should be returned to: Magazyn UNITRAILER, al. Lotników Polskich 1, 21-040 Świdnik Poland. The return should be made immediately, not later than within 14 days of the withdrawal. The period for withdrawal shall be deemed to have been observed if the Goods are sent, before its expiry. 

7.7.  If the Customer withdraws from the agreement, he or she must send back the Goods at his or her expense and risk.

VIII. Complaints regarding the Goods

8.1. As a seller UNITRAILER sp. z o.o assumes liability towards the Customer who is considered the Consumer, within the meaning of Article 221 of the Polish Civil Code, under statutory warranty for physical defects of the products set forth in Articles 556, 556[1]-556[3] and successive of the Polish Civil Code.

8.2. Complaints that result from violating the rights of the Customer that are guaranteed by the law or resulting from these Terms and Conditions should be sent to unitrailer@unitrailer.co.uk. UNITRAILER sp. z o.o commits itself to consider the complaint within 14 days. If the complaint is not considered within this period shall mean that the complaint is justified.

8.3. In case of Goods that are not manufactured by UNITRAILER sp. z o.o, the Producer bears the responsibility resulting from the warranty for the sold Goods under conditions specified in the warranty card. If the warranty card states so, the Customer may submit his or her claims, as part of the warranty, directly to the authorised directly to the authorised service point whose address can be found on the warranty card.

IX Complaints about the services provided electronically

9.1. UNITRAILER sp. z o.o undertakes actions to provide the proper functioning of the Online Shop, in a way that results from the current technical knowledge and commits itself to remove all the irregularities reported by the Customers within a reasonable period.

9.2. The Customer is obligated to immediately report to UNITRAILER sp. z o.o all the irregularities or interruptions in functioning of the Online Shop.

9.3. All the irregularities connected with the functioning of the Online Shop can be reported in writing to: UNITRAILER sp. z o.o. ul. Kuźnicza 6-8, 21-040 Świdnik Poland, unitrailer@unitrailer.co.uk or via contact form.

9.4. The complaint shall include the Customer’s name and surname, the address for correspondence, type and date of the irregularity related to the functioning of the Online Shop.

9.5. UNITRAILER sp. z o.o undertakes to consider the complaint within 14 days. If it is not considered within this period, the complaint shall be considered justified.

 X.  Consumer disputes and final provisions

10.1. The Customer, who is a Consumer, has, if he or she is interested, the possibility of having recourse to an out-of-court complaint and redress mechanism, to which the trader is subject.  All disputes connected with online shopping may be resolved through mediation process conducted by Regional Inspectorates of Trade Inspection (Wojewódzkie Inspektoraty Inspekcji Handlowej) or through proceeding before arbitration court of Regional Inspectorates of Trade Inspection. The Customer may choose other out-of-court complaint resolution method and, for instance, submit his complaint via EU ODR platform available at: http://ec.europa.eu/consumers/odr/

10.2. If the Consumer is not interested in the possibility to use out-of-court complaint resolution methods, all potential disputes between UNITRAILER sp. z o.o   and the Customer shall be resolved, according to the Polish Code of Civil Procedure, by the competent court.

10.3. The resolution of disputes between UNITRAILER sp. z o.o and the Customer who is not a Consumer shall be referred to the competent court with respect to the headquarters of UNITRAILER sp. z o.o.

10.4. To all matters not settled in the present Terms and Conditions, the provisions of the Polish Criminal Code concerning online services and other relevant provisions shall apply.
